This PA Supreme Court ruling is important for two reason. It makes clear that the Township, notwithstanding its possible reluctance to do so, Must pass hazard zoning ordinances pursuant to a Pennsylvania statue passed in 1983. The second reason is its holding that an airport owner who finds that the Township is not cooperating either with implementation of the hazard zoning or enforcing it, can force the Township to do so through a ”mandamus” procedure.
